Personal Injury Medical Evaluations & Treatments
What is Emergency Medical Condition?

Emergency Medical Condition is a medical condition manifesting itself by acute symptoms of sufficient severity, which may include severe pain, such that the absence of immediate medical attention could reasonably be expected to result in any of the following:

-
Serious jeopardy to patient health.
-
Serious impairment to bodily functions.
-
Serious dysfunction of any bodily organ or part.
EMC AND YOUR INSURANCE BENEFITS
When you experience an injury, determining if it’s an Emergency Medical Condition (EMC) is crucial, especially for your insurance coverage.

An EMC assessment should be done within the first few visits after your injury. If your injury is not classified as an EMC, your PIP medical benefits are capped at $2,500. However, to access the full $10,000 of benefits, a licensed medical professional such as an M.D., D.O., P.A., or N.P. must determine and document that you have an EMC.

By law, only an M.D., D.O., P.A., or N.P. can provide the necessary written determination to qualify for the maximum insurance benefits.
